The Family Educational Rights and Privacy Act (FERPA) is a federal law that protects the privacy of student education records. FERPA gives parents and legal guardians certain rights with respect to their child’s education records. These rights include: The right to inspect and review the student’s education records maintained by the school; The right to request that a school correct records which the parent or guardian believes to be inaccurate, misleading, or in violation of privacy rights; The right to consent to disclosures of personally identifiable information contained in the student’s education records, except to the extent that FERPA authorizes disclosure without consent; and The right to file a complaint with the U.S. Department of Education concerning alleged failures by the school to comply with FERPA requirements. These rights transfer to the student when the student reaches 18 years of age or attends a postsecondary institution, at which point the student becomes an “eligible student.” The school may disclose appropriately designated “directory information” without prior written consent, unless the parent or eligible student has advised the school in writing to the contrary. Directory information may include a student’s name, address, telephone listing, email address, photograph, date and place of birth, participation in officially recognized activities and sports, dates of attendance, grade level, and awards received.
